A Mexican judge has ruled to close a case against Francisco Garduno, the former head of Mexico's migration agency, concerning a fire that broke out in a detention center in the city of Juarez in 2023, resulting in the deaths of 40 migrants and injuries to 30 others. This incident is considered the worst in the history of Mexico's detention centers, with human rights organizations and media condemning the crumbling system of migrant detention.
Garduno was charged with misuse of authority and neglect after videos from the incident showed security guards failing to open doors despite cries for help. Although Judge Victor Manuel Hernandez Calvillón ruled that Garduno had fulfilled the judicial requirements to prevent harm, the victims rejected this decision and announced their intention to appeal it.
Miguel Zenteno, a lawyer for Justice for Migrants, stated that the ruling "confirms that justice in Mexico is selective" and means that victims will not receive full compensation or guarantees to prevent similar incidents. Zenteno also noted that the ruling is not final as lawyers will appeal it, and there are pending measures that were insufficient to address the case.
On March 27, 2023, approximately 70 men were detained in a room with no ventilation or water in Juarez's migration detention center. The fire, started by burning mattresses by a small group of migrants, led to the suffocation of the victims. Although surveillance cameras showed that guards left the site without attempting to open the doors, women detained in another room were released.
Despite the incident, Garduno continued to serve as head of the migration agency until 2025. Although the judge ordered him to compensate the victims and provide a formal apology, the measures implemented were insufficient. Compensation was paid by the agency rather than from Garduno's pocket, and victims did not receive clear instructions on how to access free medical services.
Six migration officials, including a military officer and a private security guard, along with migrants accused of starting the fire, were also charged with murder and assault. However, most of the officials involved in the incident have not been arrested or convicted.
